I'm struggling with this format. I see that my early comments to Ari never got published. Anyway, that discussion has been joined and as a UCB grad and Century City Lawyer I can see both sides of the discussion (except for the kooky argument that US-ZOG caused 9/11, {AD inserted Link} that's just sweaty nuts). But I like that we can do this, free from the overeaching security state this country is coasting into on winds of fear mongering alliance of the truly paranoid/Homeland Security entrepenuer/political posturers.

Let us review some favorite Supreme Court pronouncements (BTW, no one mentions him, but I'm pulling for Judge Easterbrook, Official brother of TMQ), courtesy of reason.com:

“Fear of serious injury cannot alone justify suppression of free speech and assembly. Men feared witches and burned women. It is the function of speech to free men from the bondage of irrational fears.” Brandeis.

“..whether the legislation under review is wise or unwise is a matter with which we have nothing to do. Whether it is likely to work well or work ill presents a question entirely irrelevant to the issue. The only legitimate inquiry we can make is whether it is constitutional. If it is not, its virtues, if it have any, cannot save it; if it is, its faults cannot be invoked to accomplish its destruction. If the provisions of the Constitution be not upheld when they pinch as well as when they comfort, they may as well be abandoned.” George Sutherland
